TEFRA NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN that on April 12, 2023, at 8:00 a.m., Mountain Time, Housing New Mexico (the “Authority”) will cause a public hearing to be conducted by a member of its staff or a designated agent by teleconference, for and on behalf of itself and the State of New Mexico (the “State”) regarding a proposal by the Authority to issue, under the provisions of the Mortgage Finance Authority Act, being Sections 58-18-1 through 58-18¬27, inclusive, and Section 2-12-5, NMSA 1978, as amended (the “Act”), pursuant to a plan of finance, two or more series of tax-exempt multifamily housing revenue debt obligations and related financing agreements (the “Debt Obligations”) for the Projects listed below. Proceeds of one or more series of the Debt Obligations will be used to finance or refinance costs incurred in connection with the acquisition, rehabilitation and/or equipping of (a) a 164-unit multifamily housing apartment project known as Sangre De Cristo, located at 1801 Espinacitas Street, Santa Fe, New Mexico 87505 and (b) a 64-unit multifamily housing apartment project known as Santa Fe Apartments, located at 255 Camino Alire, Santa Fe, New Mexico 87501 (collectively, the “Santa Fe Project”), which will be initially owned, managed or operated by JLG NM SAF 2023, LLLP, a New Mexico limited liability partnership (or an entity related to or affiliated therewith).
Proceeds of one or more series of the Debt Obligations will be used to finance or refinance costs incurred in connection with the acquisition, rehabilitation and/or equipping of (a) a 105-unit multifamily housing apartment project known as Mountainview II Apartments, located at 1515 Columbia Drive, SE, Albuquerque, New Mexico 87106 and (b) a 136-unit multifamily housing apartment project known as Mountainview III Apartments, located at 1333 Columbia Drive, SE, Albuquerque, New Mexico 87106 (collectively, the “Albuquerque Project”), which will be initially owned, managed or operated by JLG NM ABQ 2023, LLLP, a New Mexico limited liability partnership (or an entity related to or affiliated therewith).
The Santa Fe Project and the Albuquerque Project (collectively, the “Projects”) are required to be occupied by persons of low and moderate income as determined by the Authority in accordance with the Act and applicable requirements of the Internal Revenue Code of 1986, as amended (the “Code”).
The Authority is authorized to issue the Debt Obligations pursuant to the Act. Following the public hearing, the Authority will consider for adoption one or more resolutions authorizing the issuance of the Debt Obligations to finance the Projects. If issued, the Debt Obligations will be special limited obligations of the Authority and will be secured by and payable solely from revenues and other amounts pledged pursuant to individual loan agreements or other financing agreements. The Debt Obligations and the interest thereon will not constitute an indebtedness or a pledge of the faith and credit of the State or any political subdivision thereof.
Comments at the public hearing are invited. The public is invited to attend the hearing telephonically by using the dial-in information provided above and/or to submit written comments to the Authority at its offices located at 344 Fourth Street, S.W., Albuquerque, New Mexico 87102 until 5:00 p.m. on April 11, 2023. Individuals and representatives of organizations who desire to present oral testimony at the public hearing are requested to state their names at the public hearing, addresses and telephone numbers as well as the organization they represent. Subsequent to the public hearing, the Governor of the State will consider approving the issuance of the Debt Obligations solely for purposes of the Code.
