Affordable Housing Act

In 2004, the New Mexico State Legislature created the Affordable Housing Act (“the Act”) as an exception to the New Mexico Constitution’s anti-donation clause, allowing local governments and other qualifying grantees to put resources towards affordable housing acquisition, development, financing, maintenance and operation. Essentially, the Act permits public-private partnerships for affordable housing activities in New Mexico. The Affordable Housing Act Rules govern specific local housing rules under the Act.

The Act helps create local-level solutions by permitting public-private partnerships, funding projects and supporting builders. Housing New Mexico | New Mexico Mortgage Finance Authority, oversees The Act in its role as an instrument of the state. That oversight includes reviewing qualifying grantees initial affordable housing plan, providing technical assistance to qualifying grantees pursuing projects under the Act, and conducting compliance and certifications in relation to the Act.
